Agreement to terms

By creating an account or using InterviewKits.ai, you agree to be bound by these Terms of Service. If you are using InterviewKits on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

If you do not agree to these terms, do not use the platform. Your continued use of InterviewKits following any update to these terms constitutes acceptance of the revised terms.

These terms constitute a binding legal agreement between you and InterviewKits.ai, operated by Municipal Talent Consulting LLC, a limited liability company registered in the State of Wyoming.

Your account

You are responsible for maintaining the security of your account credentials. Do not share your login with others. Each subscription is issued to a single organization and is not transferable.

You are responsible for all activity that occurs under your account, whether or not you authorized it. If you suspect unauthorized access, contact us immediately at the address below.

You must provide accurate information when creating your account. Accounts created with false or misleading information may be terminated without notice or refund.

Acceptable use

You may use InterviewKits only for lawful hiring and talent evaluation purposes within your organization. You agree not to:

• • Use the platform to discriminate against candidates on the basis of any protected characteristic under applicable law, including race, gender, age, disability, national origin, religion, or sexual orientation
• • Enter false, fabricated, or misleading candidate information into the platform
• • Attempt to reverse engineer, copy, or replicate the underlying methodology, scoring frameworks, or competency structures used by InterviewKits
• • Resell, sublicense, or otherwise make the platform available to third parties outside your organization without our written consent
• • Use automated scripts, bots, or other tools to access the platform in ways not intended by its design
• • Use the platform in any way that violates applicable employment, privacy, or human rights law in your jurisdiction

We reserve the right to suspend or terminate accounts that violate these terms, without notice and without refund.

Subscriptions and billing

InterviewKits is offered on an annual subscription basis or as a one-time pay-as-you-go purchase. By subscribing, you authorize us to charge your payment method for the full annual amount at the time of purchase.

Annual subscriptions renew automatically at the end of each subscription period unless you cancel before the renewal date. We will send a renewal reminder by email at least 14 days before your renewal date.

Pay-as-you-go purchases are charged at the time of purchase and do not renew automatically.

All prices are listed in US dollars unless otherwise stated. You are responsible for any applicable taxes in your jurisdiction.

If a payment fails, we will attempt to collect payment up to three times over seven days. If payment is not collected, your account will be suspended until the outstanding balance is resolved.

Refunds

Annual plans are non-refundable. By purchasing an annual subscription, you acknowledge and agree that no refunds will be issued, in whole or in part, regardless of the reason for cancellation or non-use of the platform.

Pay-as-you-go purchases are non-refundable once a kit or Verdict report has been generated.

If you experience a technical failure on our side that prevents you from accessing a kit or Verdict report you paid for, contact us within 14 days and we will make it right at our discretion, either by restoring access or issuing a credit toward a future purchase.

Free trial users are not charged and are not eligible for refunds.

Evidence-Based Verdict™ disclaimer

Evidence-Based Verdict™ provides a structured hiring recommendation only. It does not make hiring decisions. All hiring decisions remain the sole responsibility of you and your organization.

Evidence-Based Verdict™ is an AI-powered analysis tool that synthesizes interview data and competency scores provided by your team into a structured recommendation. The quality and accuracy of Evidence-Based Verdict™ output is directly dependent on the quality and accuracy of the data your team inputs.

InterviewKits.ai makes no warranty that following a Verdict recommendation will result in a successful hire. Hiring outcomes depend on many factors outside our control, including candidate performance after joining, organizational culture, role clarity, and management quality.

You agree that InterviewKits.ai is not liable for any hiring outcome, whether or not a Verdict recommendation was followed. You further agree that Evidence-Based Verdict™ output does not constitute legal, HR, or professional advice of any kind.

You are responsible for ensuring that your use of Evidence-Based Verdict™ complies with all applicable employment, human rights, and privacy laws in your jurisdiction, including any obligations related to automated decision-making tools.

Intellectual property

InterviewKits.ai owns all rights to the platform, including the underlying methodology, competency frameworks, scoring rubrics, AI models, and product design. Nothing in these terms transfers ownership of any InterviewKits intellectual property to you.

You own the specific outputs generated for your organization through your use of the platform, including the interview kits and Verdict reports produced during your subscription. You may use these outputs for internal hiring purposes without restriction.

You may not reproduce, publish, sell, or distribute InterviewKits outputs in a way that competes with or replicates the InterviewKits product or methodology, including using outputs to train a competing AI model or build a competing product.

By using the platform, you grant InterviewKits.ai a limited, non-exclusive license to process the data you input solely for the purpose of delivering the service to you. We do not use your data or outputs to train our models without your explicit consent.

Candidate data

You are the data controller for any candidate information you enter into InterviewKits. InterviewKits.ai, operated by Municipal Talent Consulting LLC, acts as a data processor on your behalf, handling candidate names only to the extent necessary to generate Verdict reports.

You represent and warrant that you have the legal right to enter candidate information into the platform and that doing so complies with all applicable privacy and employment laws in your jurisdiction.

You agree to indemnify and hold Municipal Talent Consulting LLC and its officers, employees, and contractors harmless from any claim, loss, or liability arising from your failure to obtain appropriate consent or authority before entering candidate data into the platform.

Limitation of liability

To the maximum extent permitted by applicable law, Municipal Talent Consulting LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.

Our total liability to you for any claim arising from your use of InterviewKits, regardless of the cause of action, shall not exceed the total amount you paid to Municipal Talent Consulting LLC in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Termination

You may cancel your account at any time by contacting us at the address below. Cancellation takes effect at the end of your current billing period. You will retain access to the platform until that date. No refunds are issued for unused time on annual plans.

We may suspend or terminate your account immediately and without notice if you violate these terms, fail to pay amounts owed, or if we determine that continued access poses a risk to the platform or other users.

Upon termination, your right to access the platform ends immediately. You may request a copy of your outputs within 30 days of termination. After 30 days, your data will be deleted in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of InterviewKits shall be resolved exclusively in the courts of the State of Wyoming, and you consent to the personal jurisdiction of those courts.

If you are accessing InterviewKits from Canada, you acknowledge that these terms are governed by US law as the platform is operated by Municipal Talent Consulting LLC, a Wyoming limited liability company, and that Canadian courts are not the appropriate venue for disputes under these terms.

Nothing in this section limits your rights under applicable consumer protection laws in your jurisdiction that cannot be contractually waived.

Changes to these terms

We may update these terms from time to time as the product evolves or as legal requirements change. When we make a material change, we will notify you by email at least 14 days before the change takes effect and update the date at the top of this page.

If you do not agree to the updated terms, you may cancel your account before the effective date. Continued use of the platform after that date constitutes acceptance of the revised terms.
